1. About PitchNow
PitchNow is an AI-powered proposal creation and management platform that helps individuals and businesses create, personalise, design, collaborate on, share and track business proposals and pitches.

You must not use the Service to:
• Violate any applicable law or regulation.
• Infringe another person’s intellectual property or other rights.
• Upload or distribute unlawful, fraudulent, defamatory or malicious content.
• Introduce viruses, malware or harmful code.
• Attempt to gain unauthorised access to PitchNow or another user’s account.
• Interfere with or disrupt the operation or security of the Service.
• Scrape, reverse engineer or systematically extract data from the Service except where permitted by law.
• Misrepresent your identity, organisation, credentials or authority.
• Use PitchNow to facilitate fraud, deception or other unlawful activity.
We may restrict or suspend access where we reasonably believe these Terms have been violated.
5. AI-Generated Content
PitchNow uses artificial intelligence to help generate and improve proposals, text, recommendations, structures and other content. AI-generated content may occasionally be incomplete, inaccurate, outdated or inappropriate for a particular purpose. You are responsible for reviewing and approving AI-generated content before using, publishing or sharing it.
You should independently verify important information including:
• Prices and financial information.
• Statistics and calculations.
• Legal statements.
• Client or company information.
• Case-study results.
• Market or industry data.
• Timelines.
• Deliverables and scope.
• Claims, credentials and representations.
PitchNow does not guarantee that AI-generated content is accurate, unique, complete or suitable for your specific business purpose.
6. Your Content
You retain ownership of the content you upload, submit or create through PitchNow, including documents, text, images, logos, videos, brand assets and other materials (“User Content”), subject to any rights held by third parties.
You grant PitchNow a limited licence to host, process, reproduce, display and otherwise use User Content only as reasonably necessary to provide, secure, maintain and improve the Service, subject to our Privacy Policy and applicable law.
You represent that you have the necessary rights and permissions to upload and use your User Content. You remain responsible for the content you create and share through PitchNow.
7. Proposals Shared With Clients
PitchNow allows users to share proposals with clients, prospects, collaborators and other recipients. Depending on the settings selected by the proposal creator, recipients may be required to authenticate before accessing a proposal.
The proposal creator is responsible for:
• Ensuring that proposal content is accurate.
• Choosing appropriate access permissions.
• Sharing proposals with appropriate recipients.
• Ensuring they have the right to share information contained in the proposal.
• Managing commercially sensitive or confidential information.
PitchNow provides the technology used to create and share proposals but is not a party to the commercial relationship between the proposal sender and recipient.
8. Proposal Acceptance and Decline
PitchNow may allow proposal recipients to accept or decline proposals. Unless explicitly stated otherwise within a particular transaction, clicking “Accept Proposal” records the recipient’s stated intention to proceed with the proposal. It does not automatically constitute a legally binding contract, electronic signature, purchase order or payment obligation. The sender and recipient are responsible for determining whether additional contracts, signatures, approvals, purchase orders or other formalities are required. PitchNow is not responsible for disputes arising between proposal senders and recipients regarding scope, pricing, delivery, payment or performance.
9. Proposal Analytics
PitchNow may provide proposal creators with information about how shared proposals are accessed and engaged with. Depending on the features enabled, analytics may include information such as proposal opens, viewing activity, sections viewed, time spent, interactions and proposal status. Analytics are intended to provide useful business insights and may not always be completely accurate due to technical factors, privacy settings, device behaviour or other circumstances. Our collection and processing of personal information is further described in our Privacy Policy.
10. Templates
PitchNow provides proposal templates, layouts, design components and related materials. Unless otherwise stated, PitchNow templates and their underlying design systems remain the intellectual property of PitchNow or its licensors. Your subscription grants you a limited right to use available templates to create proposals through the Service. You may not independently resell, redistribute, sublicense or commercially distribute PitchNow templates as standalone template products.
11. Third-Party Content and Integrations
PitchNow may integrate with or provide access to third-party platforms and services, including authentication providers, payment processors, cloud services, social platforms and other external services. Your use of third-party services may be subject to their own terms and privacy policies. PitchNow is not responsible for the availability, content, security or operation of third-party services outside our reasonable control.
12. Plans, Pricing and Payments
Certain PitchNow features may require a paid subscription or other payment. Prices, usage limits and features applicable to each plan will be displayed before purchase. By purchasing a paid plan, you authorise PitchNow and its payment service providers to charge the applicable fees and taxes.
Unless otherwise specified:
• Fees are charged according to the billing cycle selected.
• Prices may exclude applicable taxes.
• Usage exceeding plan limits may incur additional charges where clearly disclosed.
• Subscription features may vary between plans.
We may change pricing or plan features from time to time. Changes affecting an existing paid subscription will be communicated as required and ordinarily take effect from a future billing period.
13. Free Trials and Promotional Offers
PitchNow may offer free plans, trials, credits, discounts or promotional offers. Such offers may be subject to additional eligibility requirements, usage limits and expiration dates. We reserve the right to modify or withdraw promotional offers where permitted by law. Promotional benefits may not be transferable unless expressly stated.
14. Cancellation
You may cancel a paid subscription through the available account or billing settings. Unless otherwise stated, cancellation takes effect at the end of the current paid billing period, and you may continue using the applicable paid features until that period ends. Cancellation does not automatically entitle you to a refund for amounts already paid.
15. Refunds
Payments are generally non-refundable except where:
• Required by applicable law;
• A specific refund policy or guarantee applies to your purchase; or
• PitchNow expressly agrees otherwise.
Any promotional refund guarantee will be governed by the specific conditions displayed with that offer.
16. Intellectual Property
PitchNow and its underlying software, interface, branding, technology, templates, graphics, designs, features and original content are owned by or licensed to PitchNow and are protected by applicable intellectual property laws.
Except for the limited rights necessary to use the Service, these Terms do not transfer any ownership rights in PitchNow to you. You may not copy, reproduce, sell, licence or commercially exploit PitchNow’s proprietary technology or assets except as expressly permitted.
17. Confidential Information
You may use PitchNow to create proposals containing confidential or commercially sensitive information. You are responsible for determining what information you upload and with whom you share it.
PitchNow will handle information under its control in accordance with its Privacy Policy and applicable law, but you should not upload information that you do not have permission to process or share.
18. Privacy and Data Protection
Your privacy is important to us. Our collection, use and processing of personal information are described in the PitchNow Privacy Policy. By using PitchNow, you acknowledge that your information will be processed in accordance with that policy and applicable data-protection requirements.
India’s Digital Personal Data Protection Act provides a framework for lawful processing of digital personal data, including requirements around consent and notices where applicable.
19. Service Availability
We aim to provide a reliable and continuously available Service, but we cannot guarantee uninterrupted access. PitchNow may occasionally be unavailable because of:
• Maintenance.
• Updates.
• Technical problems.
• Infrastructure failures.
• Third-party service outages.
• Security incidents.
• Circumstances outside our reasonable control.
We may modify, improve, replace or discontinue features as the Service evolves.
20. No Guarantee of Business Results
PitchNow is designed to help users create and manage better proposals, but we do not guarantee that using PitchNow will result in a proposal being accepted, a contract being awarded, increased revenue or any particular business outcome. Results depend on numerous factors outside PitchNow’s control, including the proposal itself, pricing, market conditions, competition and decisions made by prospective clients.
21. Disclaimer of Warranties
To the maximum extent permitted by applicable law, PitchNow is provided on an “as available” and “as is” basis. We do not warrant that:
• The Service will always be uninterrupted or error-free.
• Every feature will always remain available.
• AI-generated content will always be accurate.
• Every proposal will produce a particular result.
• Third-party integrations will always remain available.
Nothing in these Terms excludes warranties or rights that cannot legally be excluded.
22. Limitation of Liability
To the maximum extent permitted by applicable law, PitchNow and its owners, employees, affiliates and service providers will not be liable for indirect, incidental, special, consequential or punitive losses arising from your use of the Service.
This includes, where legally permitted, loss of profits, revenue, business opportunities, goodwill or data.
Where liability cannot be excluded, PitchNow’s aggregate liability arising from the Service will be limited to the amount paid by you to PitchNow during the 12 months preceding the event giving rise to the claim, subject to applicable law.
23. Indemnification
To the extent permitted by law, you agree to indemnify and hold PitchNow harmless from claims, losses, liabilities and reasonable costs arising from:
• Your unlawful use of the Service.
• Your User Content.
• Your violation of these Terms.
• Your infringement of another person’s rights.
• Proposals, representations or commitments made by you to your clients.
24. Suspension and Termination
We may suspend or terminate access to PitchNow if you:

• Use the Service unlawfully.
• Create security risks.
• Fail to pay applicable fees.
• Abuse or misuse the Service.
Where reasonably appropriate, we may provide notice and an opportunity to resolve the issue before termination. You may stop using PitchNow at any time.

We may update these Terms as PitchNow evolves or as legal and regulatory requirements change. When material changes are made, we will update the “Last updated” date and provide additional notice where appropriate or required. Continued use of PitchNow after updated Terms become effective constitutes acceptance of the revised Terms where permitted by law.
26. Governing Law and Jurisdiction
These Terms are governed by the laws of India, without regard to conflict-of-law principles.
Subject to any rights or remedies that cannot be excluded under applicable law, disputes relating to these Terms or PitchNow will be subject to the exclusive jurisdiction of the courts located in Dharamshala, Himachal Pradesh, India.
